Who we are. This website is operated by Business Brain (“we”, “us”, “our”).

These terms govern your use of businessbrain.net. They do not govern the use of the Business Brain service itself — if you are a client, your relationship with us is governed by the Service Terms and the Data Processing Agreement, which take precedence over this page for anything to do with the service or your data.

By using this website you accept these terms. If you do not accept them, please do not use it.

1. What this website is

1.1 This website describes what Business Brain is and what it does. It is information, not an offer capable of acceptance, and nothing on it forms a contract between us.

1.2 Pages describing features, capabilities, service levels or roadmap describe the service as we expect it to be provided under a written agreement. Where anything on this website differs from your Service Terms, your Service Terms apply.

2. What you may do with it

2.1 You may view, download and print pages from this website for your own business evaluation.

2.2 You may quote from it, with attribution, in the ordinary course of discussing whether to work with us.

2.3 You may not: republish it as your own; sell or license it; use it to build or train a competing product; scrape it systematically; or remove any attribution.

3. Our material

3.1 The content, design, structure and branding of this website are ours or licensed to us, and remain so.

3.2 “Business Brain” is our trading name and the name of our platform.

4. Accuracy, and what we do not promise

4.1 We take care to keep this website accurate and current. We do not warrant that it is complete, current, or free from error, and we may change it at any time without notice.

4.2 Nothing on this website is advice. It is not legal, financial, regulatory, security or professional advice, and it is not a recommendation to act. Business Brain is a tool that helps organisations keep and find their own knowledge; it does not supply that knowledge, and it does not verify it. Decisions you take remain yours.

4.3 Where this website describes what the service does, that description is about the current version. Features change. Your Service Terms describe what you are entitled to.

5. Availability

We do not promise that this website will be available uninterrupted or error-free, and we may suspend, withdraw or restrict it at any time. This clause is about the website; the availability of a client’s Business Brain instance is dealt with in the Service Terms.

6. Links out, and links in

6.1 Where we link to another site we do so because we think it is useful. We do not control it and we are not responsible for it.

6.2 You may link to our home page fairly and lawfully, in a way that does not suggest an association or endorsement that does not exist. We may ask you to remove a link and you agree to do so.

7. Your use of the website

You must not use this website in any way that is unlawful or fraudulent, that interferes with its operation or security, that attempts to gain unauthorised access to it or to any system connected to it, or that introduces anything malicious. Our full position on acceptable use of the service is in the Acceptable Use Policy.

8. Your data

How we handle personal data collected through this website — including anything you send us using the enquiry form — is set out in the Privacy Notice. How we use cookies and similar technology is set out in the Cookie Notice.

9. Our liability to you as a visitor

9.1 Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

9.2 Subject to 9.1, and because this website is provided free of charge and for information:

• (a) we exclude all conditions, warranties and other terms implied by law to the extent permitted; and
• (b) we are not liable for any loss arising from your reliance on this website, or from any loss of profit, revenue, business, goodwill, data or anticipated savings.

9.3 Subject to 9.1, our total liability to you in connection with your use of this website — as distinct from any service we supply you under a written agreement — is limited to £1,000.

10. Changes to these terms

We may change these terms. The version in force is the one published here, and the date at the top tells you when it last changed. If you are a client, changes to this page do not change your Service Terms, which can only be varied as those terms provide.

11. General

11.1 If any provision is found unenforceable, the rest continues in force.

11.2 No third party may enforce these terms.

11.3 Governing law. These terms and any dispute or claim arising out of them are governed by the laws of our local jurisdiction, and the courts of that jurisdiction have exclusive jurisdiction.
